Terms of Service

1. About These Terms

These Terms of Service ("Terms") form a binding agreement between you and Reviewbot (ABN 71 397 328 521). They apply from the moment you create an account, start a free trial, or otherwise use the ReviewBot platform at reviewbot.au. By accessing or using ReviewBot, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the service.

2. Service Description

ReviewBot is an AI-powered platform that helps businesses manage their online reputation. By using our service, you authorise ReviewBot to access your Google Business Profile and perform actions on your behalf. The service includes:

  • AI Review Response Generation — automatically drafting professional responses to customer reviews using artificial intelligence
  • SMS Review Requests — sending text messages to your customers inviting them to leave a review for your business
  • Google Business Profile Management — syncing, displaying, and posting responses to your Google reviews
  • Analytics & Ranking Tracking — monitoring your review performance, star ratings, and local search ranking over time
  • SEO Health Monitoring — weekly audits of your website's search engine optimisation health, including technical issues and opportunities

3. Account & Access

To use ReviewBot, you must sign in using Google OAuth. This grants ReviewBot access to your Google Business Profile data, including your reviews and business information. You are responsible for maintaining the security of your Google account and must not share your login credentials or approval links with unauthorised parties.

Each ReviewBot account is intended for a single business. If you manage multiple businesses, each requires its own account. We reserve the right to suspend or terminate accounts that are shared or used in a manner inconsistent with these Terms.

4. Free Trial

ReviewBot offers a 30-day free trial on both the Pro and Pro+ plans. To start a trial, you must provide a valid payment method. During the trial period, you have full access to all features included in your chosen plan.

At the end of the 30-day trial, your subscription will automatically convert to a paid plan and your payment method will be charged at the rate of the plan you selected unless you cancel before the trial period ends. You can cancel at any time during the trial from your billing dashboard with no charge and no obligation. We will send you reminder emails on day 25, day 28, and day 30 of your trial so that the conversion to a paid subscription is never a surprise.

5. AI-Generated Content

ReviewBot uses artificial intelligence to generate draft responses to your customer reviews. These drafts are intended as a starting point and may be edited before posting. You acknowledge and agree that:

  • AI-generated content may occasionally contain inaccuracies, inappropriate phrasing, or errors. ReviewBot does not guarantee the accuracy, completeness, or suitability of any AI-generated response.
  • You are ultimately responsible for all content posted to your Google Business Profile, whether that content was auto-sent by ReviewBot or manually approved by you.
  • ReviewBot is not liable for any consequences arising from AI-generated content that is posted to your profile, including but not limited to reputational harm, customer complaints, or violations of Google's policies.

We strongly recommend reviewing AI-generated responses before they are posted, particularly when using auto-send features.

6. SMS Review Requests

ReviewBot allows you to send SMS messages to your customers requesting that they leave a review for your business. By using this feature, you acknowledge and agree to the following:

  • Consent is your responsibility. You must obtain valid consent from each recipient before sending an SMS review request. ReviewBot provides a mandatory consent checkbox that you must confirm before each send, creating an audit trail. However, the underlying obligation to hold genuine consent rests with you.
  • Spam Act 2003 compliance. SMS review requests are commercial electronic messages under the Spam Act 2003 (Cth). As the originator of these messages, you are the sender for Spam Act purposes and are primarily liable for compliance. The Spam Act requires three things for every message: (a) the recipient has given express or inferred consent, (b) the message clearly identifies you as the sender, and (c) the message contains a functional unsubscribe facility. ACMA can impose civil penalties of up to approximately AUD 2.2 million per day for body corporates that breach these obligations. ReviewBot provides the technical means to comply (consent checkbox audit trail, sender identification, opt-out handling), but you must hold genuine consent for each recipient and keep evidence of that consent for at least 2 years.
  • Message limits. ReviewBot enforces a maximum of 2 messages per customer per service event to prevent over-messaging.
  • Opt-out mechanism. Every SMS sent through ReviewBot includes a functional opt-out mechanism. You must not interfere with or circumvent the opt-out process. Recipients who opt out must not be contacted again through ReviewBot.

7. Data Processing Agreement

When you use ReviewBot to collect and process customer phone numbers for SMS review requests, the following data processing terms apply:

  • You are the APP entity responsible for the personal information. Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you determine the purposes for which customer personal information (such as phone numbers and names) is collected and used. You must have a lawful basis under APP 3 for collection, give APP 5 collection notices to your customers, and otherwise comply with the APPs.
  • ReviewBot acts on your instructions. We handle customer phone numbers solely on your instruction and only for the purpose of sending SMS review requests on your behalf. Our handling of personal information is described in the ReviewBot Privacy Policy at reviewbot.au/privacy.
  • Encryption. All customer phone numbers are encrypted using AES-256 encryption at rest.
  • Retention. Customer phone numbers are retained for a maximum of 90 days from the date of collection, after which they are anonymised. You may request earlier deletion at any time.
  • No secondary use. ReviewBot does not use customer phone numbers for any purpose other than fulfilling your SMS review requests. We do not sell, share, or otherwise disclose this data to third parties except as required by law.

8. Acceptable Use

You agree to use ReviewBot in a lawful, ethical manner. The following activities are strictly prohibited:

  • Review gating — selectively soliciting reviews only from customers you expect to leave positive feedback, or filtering out negative reviews
  • Incentivised reviews — offering discounts, freebies, or other incentives in exchange for reviews
  • Misleading content — posting fake reviews, impersonating customers, or publishing false or deceptive information
  • Automated abuse — using bots, scripts, or other automated tools to interact with the service in ways that could degrade performance or exploit features
  • Violation of Google policies — any use that breaches the Google API Services User Data Policy (including the Limited Use Requirements), the Google Business Profile API Terms of Service, or Google's review and prohibited content policies. ReviewBot's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

If we reasonably believe you are in breach of this acceptable use policy, we will (where practicable) give you written notice and a reasonable opportunity to remedy the breach. We may suspend or terminate your account immediately without prior notice only where the breach is incapable of remedy, exposes ReviewBot or third parties to legal liability, or where we are required to act by law, by Google, or by our SMS carriers.

9. Billing & Subscriptions

ReviewBot offers three pricing tiers:

  • Free — limited features at no cost
  • Pro — AUD $99 per month
  • Pro+ — AUD $199 per month

No GST applies — Reviewbot is not currently registered for GST. Receipts are issued by Stripe on each successful charge. All paid plans are billed monthly via Stripe on a month-to-month basis. There are no lock-in contracts or long-term commitments. You can cancel your subscription at any time from the billing dashboard in your account settings. Cancellation takes effect at the end of your current billing period.

Subscription fees are paid in advance and are non-refundable on voluntary cancellation — when you cancel, you keep access until the end of the current billing period and are not charged again. Nothing in this section limits your rights under the Australian Consumer Law. If a consumer guarantee under the ACL has not been met, you may be entitled to a refund, a re-supply of the service, or compensation for reasonably foreseeable loss or damage. 10. Intellectual Property

The ReviewBot platform, including its design, code, branding, and underlying technology, is owned by Reviewbot (ABN 71 397 328 521). You may not copy, modify, distribute, or reverse-engineer any part of the platform without our prior written consent.

You retain full ownership of your business data, including your reviews, business information, and customer data. AI-generated review responses created by ReviewBot for your account may be used freely by you without restriction.

11. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

To the extent permitted by law, ReviewBot is provided on an "as is" and "as available" basis, and we do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate, appropriate, or fit for any particular purpose.

Where our liability for breach of a non-excludable consumer guarantee in respect of a service can be limited under section 64A of the ACL, our liability is limited (at our option) to:

  • re-supplying the service; or
  • paying the cost of having the service re-supplied.

Subject to the paragraphs above, and to the extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential, or punitive loss, including loss of revenue, profits, data, goodwill, or business opportunities;
  • we are not liable for loss caused by AI-generated content you choose to publish, downtime or changes in third-party services we depend on (including Google, Stripe, and SMS carriers), or your non-compliance with the Spam Act 2003 (Cth) or Privacy Act 1988 (Cth);
  • our total aggregate liability for all claims arising from or relating to these Terms or the service is limited to the greater of (a) the fees you have paid to ReviewBot in the 12 months immediately before the event giving rise to the claim, and (b) AUD $100.

12. Dispute Resolution

If a dispute arises in connection with these Terms or your use of ReviewBot, the parties agree to follow this process:

  1. Informal resolution. Either party may notify the other of a dispute in writing. Both parties will attempt to resolve the dispute informally and in good faith within 30 days of the notice.
  2. Mediation. If the dispute is not resolved informally within 30 days, either party may refer the dispute to mediation administered by a mutually agreed mediator.
  3. Courts. If mediation does not resolve the dispute, either party may commence proceedings in the courts of Queensland or the federal courts of Australia.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our service, our pricing, or legal or regulatory requirements.

For changes that materially reduce your rights or increase your obligations (including price increases on a paid plan), we will give you at least 30 days' written notice by email and via in-app notification before the change takes effect. If you do not agree with a material change, you may cancel your subscription before the change takes effect and you will not be charged for any period after cancellation.

For changes that do not materially affect your rights (such as clarifications, formatting, or contact details), we may update the Terms without prior notice. Your continued use of ReviewBot after a change takes effect is acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and the federal courts of Australia for any proceedings arising out of or in connection with these Terms.
